Anticipatory Bail is a vital legal provision that allows individuals to seek protection from arrest in anticipation of being accused of a non-bailable offence. The primary goal is to prevent unjust detention and safeguard personal freedom.
Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS):
When a person has reason to believe that they may be arrested on an accusation of a non-bailable offence, they may apply to the High Court or the Court of Session for a direction; the Court may, if it thinks fit, direct that in the event of such arrest, they shall be released on bail.
If such a person is arrested without a warrant by a police officer and is prepared to give bail, they shall be released. If a Magistrate decides to issue a warrant, a bailable warrant shall be issued as per the Court’s direction.
This section does not apply to cases involving accusations of offences under Section 65 and sub-section (2) of Section 70 of the Bharatiya Nyaya Sanhita, 2023.
To successfully obtain anticipatory bail, applicants must demonstrate to the court that there is a reasonable apprehension of arrest. The court typically considers the following factors:
The protection provided by anticipatory bail is not necessarily limited to a fixed period unless a special case is made out. This principle was affirmed in Ranjit Singh vs. State of Punjab (2021).
